Nagpur :- The court of 12th Joint Civil Judge Nagpur, recently rejected the applications filed by Godrej and the Agarwal family questioning the maintainability of the suit filed by Abdul Jabbar as regards the land situated at Mouza Ghoogly. It needs to be stated that the plaintiffs are challenging the sale deed executed by their mother in the year 1988 in favour of the Agarwal family. Thereafter a year back the Agarwal family had sold land admeasuring 58 acres to Godrej.
The court in nutshell has held that the question of limitation being a mixed question of law and fact will require a full dressed trial. The court has prima facie also casted aspersions on some documents allegedly executed in the year 2003 and the sale deed executed in the year 1988 in favour of the Agarwal family.t needs to be mentioned that the mother of the plaintiffs had allegedly executed a sale deed in favour of the Agarwal family in the year 1988 and signed by one Purohit being shown as a guardian of the Muslim minors Further though two children who had attained majority were shown as minors. Under the Muslim Law only the father is the natural guardian and in his absence a court appointed guardian only can act. All the above aspects are mentioned by the court while rejecting the applications filed by Ms Godrej and Agarwal family. This litigation as it appears could last for years now casting a cloud on the title of Godrej.
