VIA interacted & discussed issues reg GST with Special Commissioner of State Tax

Nagpur :- VIA Taxation & Corporate Law Forum organized an interaction meeting with Nitin Patil, Special Commissioner of State Tax, Deptt of Goods & Services Tax, Mumbai and discussed the issues related to the State GST today, 7th August, 2023 at VIA Auditorium, Nagpur.

In the beginning, CA Ashok Chandak, Chairman – VIA Taxation & Corporate Law Forum, in his welcome address briefed about issues pertaining to GST / BST Act, MVAT Act/CST Act and submitted a detailed representation.

He further highlighted major issues for his considerations like under the BST Act, MVAT Act/CST Act, the difficulty in getting registration under the MVAT Act by the Liquor and Petroleum Dealers on account of non-submission of fresh registered Lease Deed. The license for sale of a Liquor or Petroleum product may be considered in place of fresh registered Lease Deed. Matters relating to Goods & Service Tax, Input Tax Credit, Procedure for Adjudication of SCN etc. were also discussed.

Infrastructure for GST Tribunal Bench at Nagpur, it was said that the Central has a full-fledged CESTA Office at Mumbai. It may be converted as GST Tribunal Bench. However, though the Bench of MSTT exists, there is no Bench of CESTA at Nagpur. It is requested that Infrastructure of MSTT be developed, so that same can be converted as Bench of GST Tribunal. Nagpur is already approved as a place for the GST Tribunal Bench. The Nagpur Bench of MSTT has been non-working since the last 4 months for want of Judicial members. Appointment be expedited. Refund of accumulated GST on account of capital goods be claimed for a business having inverted duty structure.

Compliance of NCLT Order, it is noticed that State GST Deptt is not issuing DRC 25 or similar letters under MVAT and GST Act, as per the order from NCLT. Even though the circular issued by CBIC is accepted by the State Deptt.

On clarification of GST on Water, it was discussed that Water is exempt from Tax, therefore supply of water by any entity including Govt entity is exempt from tax, necessary clarification be issued so that Govt Agency like MIDC do not demand GST.

Nitin Patil, Special Commissioner of State Tax, Deptt of Goods & Services Tax, Mumbai assured that he will take up the matter with the concerned department and give priority to resolve the non-technical issues as well as technical issues by consulting with the technical people.

On the occasion, Vilas Padvi, Deputy Commissioner of State GST (Investigation) was also present.

CA Saket Bagdia, Past Chairman of Nagpur Branch of WIRC of ICAI made an opening remark and briefed about the purpose of conveying this important meet. CA Naresh Jakhotia, former Treasurer – VIA, proposed a formal vote of thanks.
