Nagpur – First Class Magistrate Court No. 3 at Nagpur Shri V. M. Deshmukh framed Charges against Devendra Fadnavis. Against these charges Devendra Fadnavis pleaded “not admitting the guilt “.
Nagpur based Advocate Satish Uke had lodged a complaint with the Returning Officer and later in the court alleging that Ex. C.M. of Maharashtra BJP candidate Devendra Fadnavis had concealed the details of two pending criminal cases against him in his election affidavit for the 2014 South-West Nagpur Assembly constituency. This matter gone to the Supreme Court. The Apex court had ruled that Advocate Uke’s complaint was correct and directed the Nagpur court to proceed with the case against Devendra Fadnavis. As per Advocate Uke , the criminal cases concealed by Devendra Fadnavis in his election affidavit are an offense under Section 125 – A of the Representation of the Peoples Act, 1951, so the Hon’ble Supreme Court has ordered further proceedings against Fadnavis . Section 125 – A of Representation of Peoples Act 1951 provides for imprisonment for 6 months or fine of Rs. 10,000 / – or both.
Following the order of Hon’ble Supreme Court, Devendra Fadnavis filed a review case before the Supreme Court which had been rejected by the Supreme Court. After that, Devendra Fadnavis appeared before the Nagpur court and took bail. In this case, the First Class Magistrate Court No. 3 Nagpur today framed the charges against Devendra Fadnavis. The Court asked Devendra Fadnavis thqt do he want to plead guilty , Uday Dable on behalf of Devendra Fadnavis said “not admitting the guilt” and wrote it down and signed for Devendra Fadnavis.
Devendra Fadcnavis had filed application under section 205 of Cr. P. C. & Sought exemption from personnel appearance in court and gave undertaking that his lawyer Uday Dable will remain present and will answer the allegations in his behalf , the said application had been allowed by the court. Counsel of Fadvais Adv. Uday Dable in behalf of Devendra Fadnavis told the court that “not admitting the guilt “.
The court directed Adv. Uday Dable, lawyer of accused Devendra Fadnavis , to file a Pursis on the next date of hearing 13.12.2021, that he has explained the allegations correctly to the accused Devendra Fadnavis . The Court has also directed Accused Devendra Fadnavis to file Undertaking that he has properly understood his accusation and there is no prejudice caused in recording the plea and particulars in his absence and he will not dispute the same in future . The Court also asked the complainant Satish Uke to submit fresh list of witnesses.
