– Justice Urmila Phalke Joshi has granted anticipatory bail to Anil Janardan Sawake and Ganesh Madan Wankhede.
Nagpur :- Applicants Anil Janardan Sawake and Ganesh Madan Wankhede were prosecuted by P.S.O. of P.S. Washim (Rural) for the offence u/s 352, 332, 34 of I.P.C. vide crime no. 452/2023 on 25-10-2023 upon the complaint of complainant namely Ramdas Sardar who is driver of ST Bus.
The case of the prosecution is that, on 25/10/2023 one Ramdas S/o Sakharam Sadar driver of MSRTC lodged report alleging that, on 25/10/2023 at 6.00 AM he went Washim depot and along with driver Sanjay Sharma went to village Goregaon and started at 7 AM from Washim and reached at Goregaon at 8.00 AM. They have taken passenger at Goregaon and started their return journey and they reached at village Khandala at 8.45 AM. As there was rush, some passenger were left at bus stop and S.T. bus proceeded towards Washim. At that time two persons stopped ST bus and asked him why girls students were not given place in the ST Bus to which complainant replied that there is no place in the ST bus therefore said two persons started assaulting complainant and in the process complainant suffered injury to his right hand and left leg. Meanwhile the passenger of the bus by name Sai Prabhu Idhole, Gajanan Idhole and Nagoji Vithoba Padghan rescued the quarrel. Thereafter the above two persons ran away from spot. Thereafter from persons gathered, complainant came to know that the names of those two persons as 1) Anil Sawake 2) Ganesh Madan Wankhede. Complainant further stated in his report that he made a phone call on no. 112 and informed the incident to superior officer Nandkishor Telgote and then he came to Washim Gramin P.S. and lodged the report leading to registration of instant FIR.
It was submitted that, girl students studying in different standards had to attend the schools from villages Adoli, Khandala (kh) and Jumda for attending Rajeshwar Vidyalaya, Wangi. There was no conveyance facility available for these female students for going to school at Wangi therefore from time to time the residents of village Jumda, Adoli and Khandala have filed various applications to MSRTC, requesting it to start Bus for taking the girl students to the school.
As such possibility cannot be ruled out that, complainant has been assaulted by some persons from villagers and as complainant did not know the names of assailants, he was informed names of applicants by some persons and therefore there names have been arrayed as accused. Further even as per allegations there was no use of weapon.
