– Justice Urmila Phalke Joshi has granted Anticipatory bail to Swati Manish Jain R/o Akola vide order dated 18-08-2023.
Nagpur :- Swati Manish Jain was apprehending her arrest in crime no. crime No.91/2023 registered with PS MIDC, Akola Dist Akola punishable U/s 409, 420. 120B, 34 of IPC on the report lodged by Manish Shivprasad Bharuka.
It is alleged in the complaint by the complainant that, complainant Manish Shivprasad Bharuka and one Manoj Bhikulal Agrawal doing the business of selling gram seeds (chana) under the name as style as Shamshri traders and Bhikulal Jaithmal Grain Merchants and commission agent respectively. That, other accused by name Manish Jain, and Lokesh Bhala doing business under the name as style as Unnati Corporations and Lokesh Udyog. That, as per demand of accused Manish Jain, time to time complainant and one Manoj Agrawal transported grams to the accused no. Narendra Bhala, Ashish Dorkar and Mohini Dorkar and thereafter when complainant demanded outstanding amount at that time Manish Jain and Swati Jain gave false assurance of payment and hence on the complaint of the complainant above offence is registered against Swati Jain, manish Jain, Lokesh Bhala,Narendra Bhala, Ashish Dorkar and Mohini Dorkar. The allegation was that, accused persons have taken tons of grams (chana) from various merchants including complainant and duped them to the tune of Rs. 1,48,00,000/-.
It was submitted that, in fact all the alleged transactions and business took place between accused Manish Jain, Narendra Bhala, Ashish Dorkar and Mohini Dorkar. That, Swati Jain being a wife of Manish Jain, her name is falsely implicated in the alleged crime only to pressurize entire family. That, Swati Jain is neither owner of the said firm nor doing any business. It is submitted that, there is no allegation in the FIR that Swati had transacted with the alleged victims in any manner or any property was entrusted to her.
