– Justice Urmila Phalke Joshi has granted regular bail to Asif Babu Saifi R/o Ward No.4, Gadchandur, Tah Korpana Dist Chandrapur
Nagpur :- Asif Babu Saifi was arrested on 7-06-2023 in connection with crime registered with Police Station Gadchandur vide crime no. 156/2023 for offence u/s 376(2)(n), 376 (3) 34 of IPC R/w sec 4, 6 of POCSO Act.
It is alleged by the complainant that she was having love affair with the applicant since 2020. It is further alleged that, applicant and victim had sexual intercourse as applicant had promised to marry the victim at the house of one Naved Sheikh in April 2022. It is further alleged that, on 19-05-2023 also applicant and victim had sexual intercourse at the house of Naved but her mother came to house of Naved and found out about the love affair and therefore the present FIR came to be lodged.
It was submitted that there are love relations between the victim and the accused no. 1. It is submitted that, victim herself has admitted in her complaint that, applicant and victim were having love relations. It is submitted that, victim was in the age of understanding and she was knowing the consequences of her act.
It was submitted that perusal of medical examination of victim would reveal that, there are no injuries found on the person of victim.
